The search and purchase process can be daunting to some, and others find themselves led astray by parties not concerned with your particular needs. American's brokers start by scanning the market for what is currently available suiting your needs and budget. Here to help every step of the way. American's team of brokers understands that not everyone is well versed in the purchase process of a yacht or other marine asset. We gladly provide assistance during every step, and encourage our customers to ask questions and voice their concerns. The yacht and ship purchase process is very similar to a real estate transaction. The steps outlined below are those of a "typical" transaction and meant to be a guide, but each deal is typically subject to it's own nuances. Search and Offer: Once we locate the vessel that you agree is within desired parameters using the tools mentioned above, the next step is to visit the boat in person for a showing. Should the showing be to your satisfaction, we begin the offer process which can start verbally but always ends on paper (electronic paper, that is). The electronically signed Purchase and Sale Agreement is the medium in which a formal offer is submitted and accompanied by an industry standard deposit of 10% of the offer price placed in a safe escrow account. If the seller accepts your offer, he or she signs the agreement as well and you are now "under contract." If they do not accept the price, we continue to negotiate until either a happy medium is reached or we decide to move on. If the agreement is not reached, the Purchase and Sale Agreement is null and void, and the deposit is returned. We then move on to find the next boat from whence the process is started over. Our brokers assist in providing current market valuations through a variety of means to ensure you do not overpay. Survey and Seatrial: Once "under contract", the next pertinent step is to arrange for a surveyor (both hull and mechanical) to fully inspect the boat, most often times done with you present during a seatrial. Surveyors will always need the boat to be operated to conduct a full inspection, and their duty is to find every single item of concern. This list of concerns is often conveyed verbally that day and followed by an extensive written report. These reports, typically dozens of pages long, can often be daunting to a new boat buyer as they only see a long list of "broken" items. However, a helpful surveyor will explain to a buyer on site what is or is not vitally important. Remember, they are here to find everything of consequence, whether of major concern or none at all, because their reputation is at stake...and because it is in your best interest. Your broker will also be present to assist with your concerns on the list. The boat will be hauled out at a local shipyard for the surveyor to inspect the bottom, and if needed pressure washed prior to the seatrial. The owner of the boat is typically responsible for providing a captain or authorized party to take the helm, and the buyer usually takes the cost of surveyors and haul outs. The price of which is a small one to pay considering the information gathered. At the conclusion of the survey and seatrial, there is little left to the imagination. Post-Survey Negotiations and Acceptance: Once you receive the list from the surveyor, another round of negotiations is opened between buyer and seller depending on the findings. Minor items such as out-of-date fire extinguishers and flares are usually not of consequence, but findings related to major ship's systems such as engines, generators, and air conditioners are. There are no set rules for this negotiation process, but once a buyer and seller come to an agreement on either price adjustments or repair work to be done, the buyer signs a document called "Acceptance of Vessel". This document states that the boat is in acceptable condition as is (post repairs), and the intent to move to closing is declared. If the contract lapses, repairs are not made, or a suitable price adjustment not reached by the acceptance date, the contract is negated and your ties to that particular boat are severed. Closing: The closing process is relatively simple and straight-forward provided both buyer and seller documentation are current. American utilizes a professional team of yacht closing agents that tie in to our electronic paperwork provider ensuring a smooth transition from start to finish. Sellers need to have their state registration and USCG documentation (if applicable) up to date, as well as corporate documents if the vessel is registered to a company name. Buyers will also need their corporate documents if they wish to purchase in the name of a company. The closings do not require either party to be physically present, but sellers will need to have reasonable access to a notary public for document verification. Depending on the vessel's intended journey post-sale, a few other minor forms might be needed, and if the vessel is to be kept in Florida we collect the sales tax on your behalf. The buyer now has the opportunity to enjoy their new pride and joy, and the seller can move on to their buying journey!
