Distracted driving is dangerous, claiming 3,142 lives in 2020. NHTSA leads the national effort to save lives by preventing this dangerous behavior.Distracted driving is any activity that diverts attention from driving, including talking or texting on your phone, eating and drinking, talking to people in your vehicle, fiddling with the stereo, entertainment or navigation system — anything that takes your attention away from the task of safe driving.

Texting is the most alarming distraction. Sending or reading a text takes your eyes off the road for 5 seconds. At 55 mph, that's like driving the length of an entire football field with your eyes closed.

You cannot drive safely unless the task of driving has your full attention. Any non-driving activity you engage in is a potential distraction and increases your risk of crashing.

A colleague and I was having a conversation about the trucking industry and how the company she worked for went out of business. She explained to me that one of the driver's had a blow out on the highway and had to pull over on the side of the road. While he was waiting for assistance out of nowhere a lady struck the truck from behind causing an accident. Fortunately she lived but she did have injuries, even though she cause the accident she consulted with a attorney and sued the company for millions of dollars. The company was held liable because the driver didn't put out his safety cones, something so simple could have prevented if only he put safety first.

The North American Fatigue Management Program was formed by three teams of medical and sleep scientists from Canada and the United States that did the research on the development of the program and testing its efficacy, to ensure that we developed a fully comprehensive approach to fatigue mitigation. The program provides education on the following:

Developing a corporate safety culture that actively combats driver fatigue.
Educating drivers, drivers’ families, carrier executives and managers, shippers/receivers, and dispatchers on fatigue management
Sleep disorders screening and treatment
Driver and trip scheduling practices
Fatigue Management Technologies

For the past several years, Canadian and American regulators, carriers, and researchers have worked on the development of a comprehensive approach for managing fatigue. This work has been led by a consortium of government and industry agencies with an interest in developing a more effective means of dealing with professional driver fatigue. The NAFMP Steering Committee agreed to develop a comprehensive FMP that would enhance a carrier’s ability to effectively deal with the challenges of fatigue in a highly competitive, widely dispersed, and rapidly changing industry.

FMCSA 49 CFR 395 requires that all carriers and drivers operating commercial motor vehicles (CMV) must comply with HOS regulations. Drivers sometimes find this regulation to be an inconvenience but in actuality it is a saving grace. It keep our highways safe from fatigued drivers operating a 10,000 to 25,000 pound vehicle that can possibly cause injuries or fatalities.

DOT is proposing to add oral fluid testing as an alternative to urine-based testing. DOT states that each specimen type offers different benefits to assist employers in detecting and deterring illegal drug use, especially when windows of detection are taken into consideration. Specifically, DOT’s proposed rule states that the oral fluid testing window of detection for ma*****na is up to 24 hours, whereas urine testing’s window of detection for ma*****na is 3 to 67 days. DOT invites comments on the accuracy of these windows of detection. If accurate, oral fluid testing would provide employers with a method for detecting recent use of ma*****na, which will be beneficial for reasonable suspicion testing and post-accident testing.

The FMCSA has removed ELD ONE from the list of registered electronic logging devices. FMCSA has placed ELD ONE on the revoked devices list due to the company's failure to meet the minimum requirements established in 49 CFR part 395, subpart B appendix A effective January 31,2023.

FMCSA regulation 49 CFR 382.603 is the applicable regulation requiring supervisors of commercial motor vehicle drivers who operate vehicles that require a commercial driver license to take 60 minutes of training on the symptoms of alcohol abuse and another 60 minutes of training on the symptoms of controlled substances use (120 minutes in total). The purpose of this training is to teach supervisors to identify circumstances and indicators that may create reasonable suspicion that a driver is using or under the influence of alcohol or drugs, supporting referral of an employee for testing.
