🚨 ATTENTION CDL Drivers: DOT Policy on Ma*****na Rescheduling

The news is buzzing about the President’s Executive Order to reschedule ma*****na to a Schedule III drug. But what does this mean for your CDL?

The short answer: NOTHING HAS CHANGED YET.

The DOT recently clarified that until the rescheduling process is 100% complete:

Ma*****na remains a Schedule I drug for transportation employees.

Drivers are still prohibited from using ma*****na (medical or recreational).

The FMCSA is retiring "BASICs" and moving to a new "Compliance Categories" system. This isn't just a name change—it’s a total reorganization of how your fleet is scored.

What you need to know: 🔹 Simpler Weights: Severity weights are moving to a simple 1 or 2 scale. 🔹 Recent Focus: Percentiles will now focus heavily on violations from the last 12 months. 🔹 Proportionate Percentiles: A new way of calculating scores designed to be fairer to smaller fleets. 🔹 New Segments: Driver Fitness and HazMat will now be grouped by vehicle type (Straight vs. Combination).

🚨 FMCSA Compliance Alert: URS, e-ID, and Non-Domiciled CDL Changes! 🚨

The Federal Motor Carrier Safety Administration is moving quickly on major regulatory and technological shifts that impact every carrier, safety manager, and driver. Humphrey Transportation Consultants, LLC has summarized the critical updates you need to know:

1️⃣ URS System Revamp:
The Unified Registration System (URS) is being overhauled to simplify registration, streamline identification, and incorporate enhanced verification tools to combat fraud. Get ready for a smoother, more secure online process.

2️⃣ Electronic ID Technology (Proposed Rule):
The FMCSA is moving to require all interstate commercial vehicles to be equipped with electronic identification technology. This tech will wirelessly transmit a unique ID number to enforcement officers, allowing the DOT to prioritize and focus inspections on high-risk carriers with known safety issues.

3️⃣ CDL Drug & Alcohol Clearinghouse Obligations:
The Clearinghouse remains mandatory since its launch in January 2020. Carriers must conduct pre-employment queries and annual checks thereafter. Remember: Drivers must grant permission to each carrier, and all query results must be documented in the Driver Qualification File!

4️⃣ Tightened Non-domiciled CDL Rules:
An emergency rule, implemented in September 2025, has significantly tightened criteria for non-domiciled CDLs (licenses for drivers residing outside the U.S.). New requirements include specific employment-based visas and mandatory verification via the SAVE system. Licenses are now restricted to a one-year maximum validity and require in-person renewal.

Stay informed and compliant with these key industry developments:

🔹 Double Brokering Penalties
Brokers can face fines up to $10,000 for participating in double brokering—acquiring a load and illegally re-brokering it to a carrier. This is a serious FMCSA violation.

🔹 English Language Proficiency Enforcement
FMCSA is cracking down on language requirements. Drivers who fail English proficiency standards may be immediately grounded.

🔹 UCR Fees for 2026
UCR fees remain unchanged from 2025's 25% increase, which added between $9 to $9,000 based on fleet size.

🔹 Speed Limiter Rule Withdrawn
The FMCSA has officially withdrawn the proposed rule mandating speed limiters for heavy-duty trucks.

🔹 Medical Examiner Certification Goes Digital
A new digital system is being implemented to streamline certification and combat fraud.

🔹 MC Numbers Being Phased Out
FMCSA is transitioning to use USDOT numbers only for all carriers, brokers, and freight forwarders to reduce fraud and simplify registration.

🔹 Oral Fluid Drug Testing Approved (But Not Ready Yet)
The DOT has approved oral fluid drug testing, but no labs are certified yet as of June 30, 2025. Employers must still rely on urine testing until further notice.

For over 27 years, random drug and alcohol testing has been required for commercial drivers. In 2020, the minimum testing percentages increased — and all carriers with CDL drivers are now required to:

✅ Randomly test 10% of drivers for alcohol
✅ Randomly test 50% of drivers for drugs
✅ Conduct pre-employment (drug only), post-accident, reasonable suspicion, return-to-duty, and follow-up testing

Drug use among CDL drivers is now less than half the rate of other safety-sensitive workers — thanks in part to proper testing programs.
