📢 Executive Order 14411 Update

Who counts as the Importer of Record?

The Executive Order draws a clearer line between U.S. IORs, Foreign IORs (FIORs), and companies that only appear to have a U.S. presence on paper.

- U.S. IOR: An individual or company with a legitimate and substantial presence in the United States.
- Foreign IOR (FIOR): An individual or company that does not meet the requirements of a U.S. IOR.

For an entity to be considered “located in the United States,” it should, at a minimum:
- Have its principal place of business in the United States
- Maintain a physical location where significant business activities are conducted
- Possess sufficient tangible assets within the United States

There is still more guidance to come, but a mailing address or paper company alone might no longer be enough.

⚠️ If your current import setup relies on a FIOR or third-party structure, now is the time to check how that arrangement is set up and where you may need to make changes.

📢 IMPORTANT: Executive Order 14411 Update

Beginning September 18, 2026, CBP may void Importer of Record numbers linked to inaccurate or incomplete Form 5106 information.

Importers should make sure the following details are current and belong directly to the importer:
Physical business address
Email address
Phone number

If your Form 5106 is outdated, or any of these details have changed, update it before enforcement begins.

A voided IOR number cannot be used to file customs entries, which could lead to delays, cargo holds and storage charges.

Sydney treated us pretty well! 🇦🇺

A big thank you to Freight & Trade Alliance (FTA) for a great ANZSL Conference. The panel discussions were a real highlight, and the gala dinner at NSW Parliament House was a great way to wrap up Thursday.

It was great catching up with customers, partners and industry experts over the two days.

Executive Order 14411 is set to change the way imports to the U.S. are handled, with more focus on compliance, importer responsibilities and customs procedures.

This is worth paying attention to if you’re moving freight into the United States.
