West Virginia Trucking Association Trucking is important to West Virginia. Without trucks West Virginia stops! Nearly every good consumed in West Virginia is put on a truck at some point.

The West Virginia Trucking Association was formed in 1932 to bring about an organized and uniform effort within the trucking industry for increased highway safety as well as public education on the importance and value of commercial vehicle transportation. To that end, the Association has some 260 member companies and is involved in legislative representation, government relations and many highway

safety programs. The WVTA is an integral part of the American Trucking Associations (ATA) headquartered in Washington, DC. The West Virginia Trucking Association is a statewide, non-profit, association of trucking companies, private fleet operators, industry suppliers, and other firms and individuals interested in the well-being of motor transportation at the local, state and national level. We represent businesses engaged in the transport of goods and services throughout the state. We represent both family owned and corporate trucking businesses with interstate operations. We are an association owned and operated by its members for their mutual benefit, governed by a board of directors elected from the general membership. We provide programs and activities specifically designed to assist members in finding solutions to day-to-day and long range problems and needs. Overall, an association whose members belong to an association that belongs to its members. The mission of the WVTA is to serve and represent the interests of the trucking industry with One United Voice. Trucks transport the "tangible" goods portion of the economy, which is nearly everything consumed by households and businesses. In West Virginia, nearly everything we use is transported by truck including building materials, machines, food, logs and lumber, mining equipment and other industrial products. As a result, the West Virginia trucking industry hauls nearly 70% of all freight transported. Nationally, the trucking industry is an astounding $610 billion industry (in 2003), representing 86.9% of the nation's freight bill. In addition, trucks transported 81.36% of total manufactured tonnage in the state in 2013.

FMCSA has zero tolerance for fraud in our safety systems โ€“ that includes the Drug and Alcohol Clearinghouse.

Weโ€™re rolling out enhanced identity verification, starting with new registrations for employers, Medical Review Officers, Consortium/Third-party administrators (C/TPAs) and Substance Abuse Professionals through IDEMIA โ€“ the same platform used by TSA.

With more than 6 million users in the Clearinghouse, the stakes are too high to leave any gaps.

Next, these stronger standards will be applied to all existing Clearinghouse accounts for the same user groups

If youโ€™re in the system, youโ€™ll be verified. Period.

๐Ÿ“ข INDUSTRY ALERT: Major FMCSA Rule Changes Effective

Today (March 23, 2026)

To all PTAG members:

The FMCSA finalized a "Regulatory Purge" on February 19, 2026, aimed at removing outdated and redundant requirements. As of this morning, March 23, several of these changes are officially live.

While some news alerts are framing this as a "crackdown," the reality is actually a win for carriers. Most of these updates are deregulatory, meaning they remove the "gotcha" violations that have plagued our industry for years.

๐Ÿš› What You Need to Know: 4 Key Changes

* Electronic DVIRs (Part 396) Officially Recognized The FMCSA has updated the language in Part 396 to explicitly allow electronic Driver Vehicle Inspection Reports.

While most of us already use digital systems, this removes any legal ambiguity.

Inspectors now have a clear standard to follow, which protects carriers using digital records from "gray area" paperwork citations.

* The 95% Fuel Tank Limit is GONE For decades, fuel tanks were required to be designed to prevent being filled past 95%.

FMCSA has officially removed this restriction. Modern vented caps make this old rule obsolete. You will no longer face citations for tanks filled to 100% capacity.

* Rear-Impact Guard Certification Labels This is a huge win for maintenance teams. You are no longer required to maintain the permanent manufacturer certification label on the rear-impact guard.

If the sticker falls off or becomes unreadable, it is no longer a violation, provided the guard itself is structurally sound.

* License Plate Lamps (Tractors) Tractors are now exempt from requiring a working rear license plate lamp while towing a trailer.

Since the trailer blocks the plate anyway, the FMCSA has ruled this lamp unnecessary during transit. (Note: The lamp must still work if the tractor is bobtailing).

โš ๏ธ One Important "Sunset" Item:
* Liquid-Burning Flares: The FMCSA has officially removed liquid-burning flares as an approved emergency warning device.

If your older trucks are still carrying these, they must be replaced with reflective triangles or solid-fuel flares immediately to avoid a citation.

๐Ÿ› ๏ธ What should you do today?
* Update Your Pre-Trip Checklists: Remove the "95% fuel limit" and "rear-impact label" items so your drivers aren't wasting time on non-violations.

* Maintenance Briefing: Ensure your shop knows they no longer need to hunt down replacement stickers for rear bumpers.

* Check Emergency Kits: Ensure all trucks have switched from liquid flares to triangles.

The Bottom Line: These changes are designed to cut red tape. Use today to align your checklists with the new standards so your competitors aren't the only ones benefitting from the reduced burden.
