🚛 ATTENTION ALL OWNER OPERATORS KNOW YOUR RIGHTS OR GET TAKEN EVERY TIME 🚛

If your is sending you a text message summarizing a load instead of the actual that is not acceptable and you do not have to tolerate it.

Here is what you need to know, what you need to say, and what you need to DO if they refuse:

KNOW THE LAW:

Under 49 CFR Part 376.12 the Truth in Leasing regulations enforced by the FMCSA the carrier is required to maintain records and documentation covering every trip in which your equipment is used.

You are entitled to access those documents on every single load. These regulations apply to the carrier, their affiliates, AND their agents. No one in that chain can legally withhold your Ratecon from you.

WHAT TO SAY:

I require the actual Rate Confirmation on every load before I accept it. This is not a personal preference it is my federal legal right under 49 CFR Part 376.12. Send me the full Ratecon before I dispatch. I need the complete rate, broker information, pickup and delivery details, and all terms in writing. I know this industry and I know my rights.

IF THEY REFUSE :HERE IS HOW YOU USE YOUR HANDS:

⚖️ Step 1 : Document Everything
Save every text, every email, every conversation where they denied you a Ratecon. Screenshots. Dates. Times. All of it. Documentation is your ammunition.

⚖️ Step 2 : Send a Written Demand
Send them a written message text or email formally demanding the Ratecon and citing 49 CFR Part 376.12. Put it in writing so there is a paper trail they cannot deny.

⚖️ Step 3 : File a Complaint with the FMCSA
Go to nccdb.fmcsa.dot.gov or call 1-888-368-7238 and file a formal complaint.

This is free. This is federal. And carriers take it seriously because it goes on their record.

⚖️ Step 4 : Contact a Transportation Attorney
If they have been withholding Ratecons and shorting your settlements you may have grounds for a lawsuit. A transportation attorney can review your lease agreement and settlements and tell you exactly what you are owed. Many work on contingency …

meaning they don’t get paid unless YOU get paid.

⚖️ Step 5 : Report Them to the OOIDA
The Owner Operator Independent Drivers Association exists specifically to protect drivers like you. Contact them at ooida.com or 1-800-444-5791.

They have legal resources and will go to bat for you.

🛑 They are counting on you NOT knowing this.

🛑 They are counting on you being too tired to fight.

🛑 They are counting on your silence.

✅ You have the right to every Ratecon
✅ You have the right to know the full broker rate
✅ You have the right to detailed settlements
✅ You have the right to sue if those rights are violated
✅ This is FEDERAL LAW not a company policy
