FMCSA increases the allowed area for mounting devices on interior CMV windshields

The Federal Motor Carrier Safety Administration (FMCSA) has updated current regulations to allow drivers to mount certain vehicle technology safety devices on a larger area on interior CMV windshields.

In a Final Rule published in the Federal Register on March 7, 2022, the FMCSA stated the agency would amend regulations to increase the allowable area for mounting “vehicle safety technologies” from the currently allowed 4 inches from the distance below the upper edge of the area swept by the windshield wipers.

Under the new rule, the the allowable area is 8.5 inches below the upper edge of the area swept by the windshield wipers.

The rule will go into effect on May 6, 2022.

The Final Rule was issued in response to a rule making petition filed in 2019 by Daimler Trucks North America (DTNA).

The regulation requiring that antennas and similar devices must not be mounted more than 6 inches below the upper edge of the windshield, and must be outside the driver’s sight lines to the road and highway signs and signals remains in place.

The Final Rule also expands the definition of “vehicle safety technologies” to include braking warning systems, braking assist systems, driver camera systems, attention assist warning, GPS, and traffic sign recognition. Previously, accepted “vehicle safety technologies” included fleet-related incident management systems, performance or behavior management systems, speed management systems, lane departure warning systems, forward collision warning or mitigation systems, active cruise control systems, and transponders. Vehicle safety technology includes systems and devices that contain cameras, lidar, radar, sensors, and/or video, according to FMCSA.

I-80 west in Utah closed for multi-vehicle crash involving semis, trooper
March 2, 2022

The Utah Highway Patrol (UHP) has reported a multi-vehicle crash blocking westbound I-80 near Grantsville.

The crash occurred around 10 a.m. on Wednesday in Tooele County, Utah.

According to reports, a Utah trooper pulled over a semi truck on westbound I-80 near mile marker 85.

A second semi truck driver saw the traffic stop and reportedly tried to move over, but struck a black passenger vehicle.

The driver of the second semi truck then overcorrected and struck both the Utah trooper’s vehicle and the semi truck that was pulled over.

One of the trailers broke open during the crash, spilling packages of eggs all over the interstate.


Two people in the black passenger vehicle were injured, but both are expected to survive.

UHP said shortly after 12:30 p.m. that cleanup of 2 to 3 hours is expected before westbound I-80 reopens.

FMCSA again extends 50 state HOS relief for COVID-19 supply haulers

The Federal Motor Carrier Safety Administration (FMCSA) has opted to extend an expiring emergency declaration providing regulatory relief for drivers hauling certain supplies during the pandemic.

On February 26, 2022, the FMCSA issued an extension through May 31, 2022, for an Emergency Declaration to provide relief from Parts 390 through 399 of the Federal Motor Carrier Safety Regulations (FMCSRs), which includes Hours of Service requirements, for drivers who are providing direct assistance during the pandemic.

The previous extension was issued on November 29, 2021, and was set to expire on February 28, 2022.

The FMCSA says that the extension was issued in spite of the fact that COVID-19 cases are on the decline because “persistent issues arising out of COVID-19 continue to affect the U.S. including impacts on supply chains and the need to ensure capacity to respond to variants and potential rises in infections. Therefore, a continued exemption is needed to support direct emergency assistance for some supply chains.”

The waiver extension applies to truck drivers who are hauling the following supplies in direct support of COVID-19 relief efforts:

1. Livestock and livestock feed
2. Medical supplies and equipment related to the testing, diagnosis and treatment of COVID-19
3. Vaccines, constituent products, and medical supplies and equipment including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19
4. Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap and disinfectant
5. Food, paper products and other groceries for emergency restocking of distribution centers or stores
6. Gasoline, diesel, jet fuel, and ethyl alcoho
7. Supplies to assist individuals impacted by the consequences of the COVID-19 pandemic (e.g., building materials for individuals displaced or otherwise impacted as a result of the emergency)

📍Keep a safe buffer zone around your truck

Leave plenty of room between your vehicle and the vehicle in front of your truck, and beside your truck, when possible.

📍Never push beyond the limits of your equipment
Knowing what your equipment can handle is very important. It’s one of the best ways to stay safe.

📍Carry a bag of kitty litter — under your bunk.

Warm tires can turn that snow you parked on into a patch of ice in a short time. Throwing kitty litter under your tires is a good and environmentally safe way to get that little bit of extra traction needed to get you going.

📍Carry a hammer & putty knife — Air tanks can freeze up pretty quick.

If you’ve been driving in excessive amounts of snow, you’ll get under the truck and make sure there’s no snow or ice packed up on my air tanks.

Maine law banning loggers from hiring immigrant truckers blocked by federal judge

A federal judge has blocked a Maine law that previously banned logging companies from hiring immigrant truckers to haul their logs within the state.

The bill prohibiting forest landowners and trucking companies from using immigrant laborers to haul logs harvested in Maine for delivery in Maine was passed in the Spring of 2021 and was sponsored by Senate president Troy Jackson – a former professional logger who felt that Maine timber companies were taking jobs away from Maine residents by illegally hiring Canadian workers for less money.

US District Court Judge John Woodcock has since granted a preliminary injunction against the law. Woodcock says that Maine state officials may have legitimate concerns about the use of foreign laborers under the H-2A visa program, but the law banning the use of these workers “is not a constitutional means of addressing these concerns.” Woodcock also says the now-blocked law is an attempt at overriding federal immigration law, reported Maine Public.

The Maine Forest Products Council, among others, argued that the now-blocked law not only allowed Maine to overstep its legal authority, but also violated the “equal protection” provisions of the Maine and U.S. constitutions. Executive Director of the Forest Industry Trade Group, Patrick Strauch, says that the logging landowners and trucking companies only apply to hire laborers from Canada because they can’t find Americans willing to do the job.

“What this law did was enforce the federal law of point-to-point hauling in Maine, which happens nowhere else in the United States,” Jackson said Tuesday, arguing that “point-to-point” hauling jobs should be reserved for American citizens.

The suspension of the law is only temporary, and additional court action is expected.
