What does the clause "unless otherwise provided by law" inserted in the proposed amendments to the 1987 constitution as jointly filed by the senate and HOR as a resolution means? If it passes, this means our legislature have accorded to themselves superiority over the constitution. That thru a mere law enacted by congress constitutional provisions can be redirected away from its intended spirit. It is entirely different from the clause "as maybe provided/defined by law" frequently used by the 1987 constitution on its non-executory provisions. The latter provides no room to veer away from the spirit of the provision. The former does provide such option.

Senate President Migz Zubiri today filed a joint resolution of both the Senate and HOR proposing three items to be amended in the 1987 constitution allegedly to avert any constitutional crisis and preserve the bicameralism of the legislature.

The amendments only touches on franchises/authorization of public utilities, educational entities and advertising services.

While the language of each of the proposed amendments appear to reiterate the spirit of the 1987 constitution in each of the proposed amendments' predicate, the clause "unless otherwise provided by law" inserted in each proposed amendments would now make congress eligible to enact laws that may in fact contrary to the spirit of the affected provisions of the constitution.

This is a backdoor provision akin to facilities incorporated in software applications by its designers to enable authorities and even hackers to violate our privacy. Only this time it's the country and the citizenry wholesale on its patrimony!!

Charter Change on the Economy:

When countries in South/Central America, Africa and Asia are trying to break free from the tentacles of imperialism and neo-colonial influence tayo naman gusto ng mga proponents ng charter change na ibalik ang conditions where foreign control of major and critical sectors can be made easy. Parang wala tayong natutunan sa Parity Rights at Tyding-McDuffie laws after liberation.

Charter Change on Governance:

Elite rule is the root cause of all our woes. When the colonial masters left yong mga elites na kababayan natin took over and practiced the very same unjust governance over us. No amount of political reforms will correct the current conditions unless this elite rule is put to end. Until after they enact the anti-political dynasty law any proposal from the current breed of politicians will be a suspect.
