Educational assistants are subject to Decree No. 2.24.140 issued on February 23, 2024, relating to the basic system for employees of the Ministry in charge of National Education, where educational assistants, under Article 22, undertake the tasks of assistance in administrative, educational, financial and material management, preservation and archiving work, and contribute to the implementation of the work and tasks assigned to the appointed services .
In this context, we at the National Association of Educational Assistants received with astonishment a set of irregularities related to the tasks and competencies of educational assistants, following the issuance by the Ministry of National Education, Preschool and Sports of the description cards for professional examination tests for bodies working in the national education sector for the December 2023 session, and the draft reference guides for jobs and competencies, especially cases of conflict due to the ministry’s violation of legislation and legal texts, and its conflict with the basic tasks of an educational assistant framework, which
It will only increase the level of congestion and tension between the administration and this group that is marginalized and exploited .
It is worth noting that the new statute has been reformulated in Article 22, and this amendment included the cancellation of support for logistics services, and the treatment of some texts that were included in the previous decree No. 2.23.819 issued on 20 Rabi’ al-Awwal (October 9, 2023) in the Official Gazette No. 7237, which raises more than one question mark about the feasibility of adopting a new statute, if its articles and decisions will not find their way to implementation, in the absence of legal means capable of imposing respect for the prestige of legislative institutions. Accordingly, we, in the office of the National Association of Educational Assistants :
We note a violation of the legal texts and the Ministry’s monopoly on some improvised and provocative proposals in the description cards for professional examination tests, and in the reference guides that conflict with the articles of the new basic system and that affect the rights of educational assistants .
We completely reject targeting the status or dignity of assistants through the formulation of some phrases and terms. We demand a review of the last paragraph of Article 83 and amending the wording of the third paragraph of Article 22 .
We call on the Ministry to commit to approving tasks related to administrative and educational assistance included in the new basic system, while preventing any form of illegal interference in some delegated management tasks and attempts to implicate assistants in tasks that do not legally oblige them and are not consistent with their competencies. We call on the Ministry and the government to implement the agreement of December 10, 2023, and to approve a monthly compensation for educational assistants equal to 500 dirhams per month and to create compensation similar to all administrative and educational frameworks and all legitimate demands ...
We call on all activists, both male and female, and all employees to close ranks and prepare to confront all attempts to disrupt and influence all the legitimate demands of the assistants. We affirm our determination to inform the national public opinion about engaging in escalating forms of struggle in the event that the ministry persists in practicing its irresponsible methods against this group.
