Airlines are responsible to pay for compensation when your flight is delayed, cancelled or overbooked subject you satisfy the eligibility criteria. However, their liability can be discharged only for extraordinary circumstances. An event has to meet the three criteria unpredictable, unavoidable and external to be considered as extraordinary circumstances.

The airlines have to provide proof of the circumstances alleged and they must also clearly demonstrate how these circumstances resulted in flight disruption. Remember that the incident needs to be evaluated in the context of the category to which it relates.

Examples of extraordinary circumstances due to Air traffic Management issues:
1. where Air Traffic Control suspends or restricts operations out of the airport of departure or into the airport of arrival.
2. where Air Traffic Control suspends or restricts operations into or out of air space through which the airlines must travel in order to operate the flight.

Always remember that you are eligible to claim for flight compensation under EU Law as far as your flight departs from an EU airport and lands at a non EU airport, regardless of the nationality of the airline OR when your flight is carried by an EU airline and lands at an EU airport and subject you meet the time and distance eligibility criterias!

Claim for flight delay! What do you need to know...

1. You can claim for flight delayed now or dating back to 2008.

2. You MUST arrived more than three(3) hours late.

3. Any flight from EU airport counts, or any flight irrespective of the country to an EU airport.

4. The compensation amount is fixed per passenger and it is based solely on delay (calculated at arrival) and journey length.
