The August 19 deadline is just a few days away. If you ship products from Canada into the United States, these are the five things you need to do before then.

The new Section 338 tariffs impose an additional 50% duty on specified Canadian-origin goods, and CUSMA compliance will not protect covered products. The trigger is the customs entry date, not the order date or the ship date. That distinction alone catches most brands off guard. ⚠️

CUSMA compliance was the foundation of cross-border ecommerce between Canada and the United States. πŸ‡¨πŸ‡¦πŸ‡ΊπŸ‡Έ For a significant range of Canadian-origin products, that foundation shifted on July 20, 2026. Unless changed before then, an additional 50% U.S. duty under Section 338 of the Tariff Act is scheduled to take effect at 12:01 a.m. Eastern Time on August 19. ⚠️

CUSMA does not exempt covered products from this additional duty. A valid CUSMA origin certification may still allow the importer to claim preferential treatment from the normal customs duty, but it does not remove the Section 338 duty on top of it.

Coverage extends well beyond the headline sectors of motor vehicles, alcohol, and dairy. Furniture, clothing, cement, plywood, wigs, hockey equipment, and hundreds of other product lines appear in the proclamation annexes, and the exact HTSUS classification determines whether a product is covered.

The effective date, if it proceeds as scheduled, is based on when goods are entered for U.S. customs consumption, not when the order is placed or when the parcel is shipped. πŸ“¦ That distinction matters for inventory currently in transit.
