On January 17, 2022, the HCV Store, a Black‑owned business at 108 S. Main St., Swanton, Ohio, was broken into, vandalized, and targeted in a hate‑crime:
🚪 Front door kicked in – clear forced entry.
🎨 Racial slur “NIGGER” spray‑painted in large letters inside the store.
💰 Massive property damage and economic harm to a Black‑owned store.
🚔 Swanton PD is located within close proximity yet delivered a delayed and inadequate response.
This was not “just vandalism.” This was a documented hate‑crime against a Black family’s livelihood.
🟥 NAMED SUSPECT IGNORED – KEYS, LAYOUT, MOTIVE 🟥
Victim Jacqueline Kimble immediately gave police a prime suspect:
👤 ALONZO JONES STEWART – her ex‑boyfriend who:
🚗 Stole her car and ALL her keys, including the HCV Store key, in September 2021.
📝 Has police reports in Toledo and Detroit.
🏬 Had been inside the store 3–4 times and knew the layout.
🔑 Keys were never recovered.
Yet instead of laser‑focusing on this suspect with motive, means, and opportunity, Swanton PD flipped the script and turned the victims into suspects.
🟥 VICTIMS TURNED INTO SUSPECTS – “INSIDE JOB” GAME 🟥
Instead of centering the hate‑crime and the named suspect, Swanton PD:
Dragged Jacqueline Kimble into a small room at the station and subjected her to a custodial‑style interrogation.
Never read Miranda rights – no warning, no right to counsel advisement, nothing.
Pressed an “inside job” theory, obsessing over whether she turned off a light switch that powered a camera.
Suggested that because the camera cut off when she walked into the office, she might have shut off surveillance.
All this, while she:
Was listed as a VICTIM in documentation.
Was not present when the break‑in and hate‑crime occurred.
Gave them a full suspect name and backstory.
This is not neutral questioning – this is victim‑to‑suspect flip.
🟥 COERCIVE FINGERPRINTING & DATA GRAB – A VICTIM PROCESSED LIKE A CRIMINAL 🟥
During that same interrogation, Swanton PD:
Took full ten‑finger prints from Jacqueline, calling them “exclusionary prints,” despite:
No probable cause.
No warrant.
No evidence she was at the crime scene when it happened.
Collected hyper‑sensitive personal data in that coercive setting:
Full Social Security Number
Date of birth
Height, weight, eye color
All of this happened while she sat in a police interrogation room, never told she was free to leave, never Mirandized, and treated like a suspect in her own family's hate‑crime case.
⚖️ That’s a Fourth Amendment problem (unreasonable search/seizure) and a Fifth Amendment problem (custodial interrogation with no Miranda), stacked on top of Fourteenth Amendment equal protection issues.
🟥 “DNA HOSTAGE” – MINISTER KIMBLE’S DNA SEIZED & HELD FOR YEARS 🟥
Swanton PD didn’t stop with Jacqueline. They went after Minister Kimble’s DNA:
Swanton PD seized Minister Marquis L. Kimble’s DNA during the investigation.
He is listed as a VICTIM, not a suspect.
He has never been charged with any crime.
Yet his DNA has been held for over 1,400 days – while the case was labeled “NO SUSPECTS.”
Then, when confronted about this blatant abuse, defense counsel for Swanton PD & Mayor Neil Toeppe reportedly mocked the issue in open proceedings:
“What does the plaintiff want us to do? Give him his DNA back?”
That is not a joke. It is a public confession of contempt for bodily integrity, privacy rights, and constitutional law.
This is why we are calling it a “DNA HOSTAGE” situation.
