Before you call for Return-to-Duty help, do this first:

Log into your FMCSA Clearinghouse account.

This helps you understand exactly where you are in the process before asking for guidance.

When you call for help, be ready to answer:

✅ What does your Clearinghouse status currently show?
✅ Are you listed as prohibited?
✅ Have you already completed your SAP evaluation?
✅ Has a SAP been designated in the Clearinghouse?
✅ Did the SAP say you are eligible for RTD testing?
✅ Have you already taken a Return-to-Duty test, or only a regular drug test?

Having this information ready can save time, reduce confusion, and help you avoid taking the wrong next step.

The alleged father is unavailable—but you still need answers. What are your options? 🧬

A grandparentage DNA test may help determine whether a child is biologically related to the alleged father’s family. Whenever possible, including both paternal grandparents and the child’s biological mother can strengthen the analysis.

Your first move is simple:

**Remove the driver from safety-sensitive duties immediately.**

That means the driver should not be dispatched to operate a commercial motor vehicle or perform DOT safety-sensitive work while prohibited.

After that, your company should document the situation, provide SAP referral information, review any required Clearinghouse reporting responsibilities, and keep the records organized in the driver’s compliance file.

This is not the time to guess, delay, or wait until the next day to figure out your process.

For small fleets, one missed step can create serious compliance problems.

Important reminder: providing referral information does not mean you are guaranteeing when the driver can return to work. The driver must complete the required Return-to-Duty process before returning to DOT safety-sensitive duties.

DER RESPONSIBILITIES AT A GLANCE

If a drug or alcohol test result comes in today, who inside your company is responsible for taking action?

That person is often called the DER, or Designated Employer Representative.

In simple terms, the DER is the person responsible for handling important drug and alcohol testing decisions inside the company.

The DER may receive test results, coordinate testing, communicate with the MRO or testing provider, remove a driver from safety-sensitive duties when required, and make sure the company follows the correct process.

For small trucking companies, this role is very important.

You do not want to wait until there is a positive test, refusal, or post-accident situation to figure out who is responsible.

Every company with CDL drivers needs a clear process.
